Someone keeps flagging my CJ8 CL ad for removal.......

...so I reworded and reposted it.

https://phoenix.craigslist.org/wvl/cto/d/roselle-wanted-jeep-cj8-scrambler-dont/6838778845.html

It appears as if someone in Arizona doesn't like other people competing with them to buy a Scrambler. My ad has been flagged several times for removal. Who is this scoundrel? Is it a greedy dealer who is looking to give you pennies on the dollar for your Scrambler and then turn around and sell it on eBay for crazy money? I suspect so. If you have a Scrambler for sale, sell it to a car enthusiast like myself, who will give it a good home, rather than a money grubbing sheet metal merchant who only sees profit for their selfish self.

Below is my ad:

I am in search of an original Scrambler. The more original the better. Faded original paint with patina, no problem. Prefer running and driving. Please contact me with what you have for sale. Thanks in advance!

Your ad contains photos of different Scramblers and even someone's business sign. Do you have permission to use the photos in an ad? Maybe it is someone who owns one of those Scramblers or that business owner who might be getting calls because of your ad? If you posted pix of my Scrambler in an ad, I would certainly object. Your re-worded ad assumes the worst and is totally inappropriate.

That's a good point. One of the Scrambler's owners actually contacted me to tell it was his. We had a nice chat over several emails. That's how these things should go. But you're right, I should delete the pic with the business in the background. Thanks!

You should delete all of the photos unless you have permission to use them in an ad.
Really? Do you think that's too extreme? The photos were found in the public domain on Google. I can see deleting pics with business info in the background, but also random pics found on Google?

Just because images show up in Google searches does not mean they are in the public domain. I'm a professional photographer and many of my images show up in Google searches for various things. Those images are not in the public domain.

I would suggest reading this: https://www.copyrightlaws.com/copyright-tips-legally-using-google-images/

I know of someone who regularly posts every image he can find of certain Jeep vehicles. Unless he created those images himself, there is the chance of copyright violation becoming an issue. The chances are slim, but they exist. The United States Copyright Act provides that the copyright for an image remains with the person who created it unless specifically transferred.

Honestly, I think that's excessive. I can see your perspective being a photographer, but I am in no way profiting from these images. But just to be safe, who here will volunteer images of original CJ8s to
use as visual tools?

Funny someone keeps flagging it, but here's a few points from my perspective. No, I didn't flag it.

1) Maybe because you have a "wanted" ad in the cars for sale section? Maybe because you have a price but are not selling anything?

2) I'm guessing the person flagging it is similar to you. Just looking for a good Scrambler -- not necessarily to flip it either. Like a bunch of us always are.

3) Not to disparage the car salesmen or your ad, but your ad is exactly what somebody would say if they wanted a wholesale-priced Scrambler and planned to flip it. When you actually break down your ad to an educated buyer/seller, it says:
"Sell me your Scrambler before listing it somewhere that gives you exposure to a broader market that could provide you with the highest price."

Honestly, I have used similar selling tactics when talking with owners who weren't yet sellers or friends of those owners. I've even responded to a similar ad, but threw out an outrageous price to see where it would go. That ad was by a collector and sometime flipper (who I now consider a friend). Anyway, welcome to the search for a solid original paint Scrambler.

Just my two cents,

One more thought, I am very surprised a well-known flipper in Colorado hasn't hasn't flagged your ad in Colorado Springs.

I suspect he is the one who has already contacted me wanting to sell me a CJ8, in fact, more than one and even some parts, because of my ad. I'd bet we're talking about the same guy. I might surmise, he may be under the impression I am a fabulously wealthy. "price no object" collector, rather than someone looking to have some fun in a Scrambler. :)

Feel free to PM me, we can compare notes.

The law is sometimes excessive. In addition, you are violating the Craig's List Terms of Use by posting images that you do not have permission to use. But yes, I agree that it is probably no big deal to use the images, though using them in an ad is pushing it. I've posted many images that I might have found online or in other forums, but I always try to credit the source..

Just my two cents,
I do realize it's in the for sale section vs wanted. The wanted section gets zero exposure. The price is just a random number I plugged in to complete the requirements. So in an oblique way, sounds like you think the ad verbage is effective! ;)

So let me see if I have this straight...You violated Craigslist Terms of Use in at least 3 ways (see below) and you have started a thread to complain about your listing being removed?

Prohibited content:
  • anyone’s personal, identifying, confidential or proprietary information
  • spam; miscategorized, overposted, cross-posted, or nonlocal content
  • any good, service, or content that violates the law or legal rights of others
It's great that you are trying to get into a Scrambler. I just think you have gone about it in the wrong way. Do your homework. There appear to be quite a few out there for sale at this time. Don't expect Scrambler owners to beat a path to your door.

The purpose of having such an ad is to find the item I seek. I fully agree about posting pics with other info in them. An unintentional oversight on my part which, with your suggestion, I have now corrected. I only partially agree on use of publicly available images however, but nevertheless I have owners permission now.

Regarding which section it should be in, you have a point. But if the object of the exercise is to successfully find an item, that’s the only section worth posting in. Anyone who's ever perused CL, knows how common those ads are.

The complaining is more due to my suspicions that a specific individual or entity simply doesn’t want that specific ad up in that specific place. Perhaps they feel their turf has been invaded. Who knows.

You’ve been helpful and I appreciate your help, but I’m still looking for a rust free Scrambler and that ad is just one of the tools I’m using. In fact, one might also consider this thread about that ad, as another tool to get the word out on what I'm looking for.

Thanks, I hope we’re all friends here.

It might be flagged only because it's a wanted ad in a for sale section.

I hear what you're saying about Wanted sections not getting much traffic. I think that's true.

Yeah, maybe. But I've posted ads like this for years with no issues. It's only this one that's been singled out.

Welp, flagged for removal again. 7th time in 10 days. It's almost become a matter of principle to put it back up, now. At least I got another lead from it today. Hopefully pics tomorrow. Looking for a six, but this one is an Iron Duke. How underpowered is an Iron Duke Scrambler? Probably not safe for highway use?
